OFFICIAL RULES AND CONTEST TERMS
My East Oakland - Photo Contest
No purchase needed to enter. Void where prohibited by law.
All photos and descriptions must be submitted by upload at ouroakland.org or mailed in/dropped off per Guidelines. Emailed submissions will not be accepted.
Entrants under 18 years old must also have permission of his or her parent or legal guardian. By entering, Entrants under 18 years old represents that he or she has such permission. Contest organizers will contact parents or legal guardians of Finalists. Entrants under 18 years old who do not have permission from their parent or legal guardian may be disqualified and their work removed from the website.
Each submitted photograph, in its entirety, must be a single work and not a composite.
The photo should be submitted as a ‘high resolution’ JPEG, maximum 2 MB.
All submissions must be original work by and exclusively owned by the person submitting the entry. You must be the photographer for the image you are uploading. Additionally, you must write your own description. Using copied photos or written material may esult in disqualification and removal of work from the website.

By submitting an entry, each Entrant (and his or her parent or legal guardian) warrants and represents that the entry, and his or her submission:
- Does not violate any law, regulation or right of any third party, including but not limited to patent, copyright, trademark, or other intellectual property right,
- Does not violate any fiduciary relationship or violate any agreement,
- Is the Entrant’s own sole and original idea, and,
- Does not contain any virus, bugs, or other deleterious material
- Entries may be disqualified for inappropriate language or imagery, which Our Oakland staff shall determine in their sole discretion. We would like to be able to display your images in public via media or other outlets, thanks!
Once an entry is submitted, it cannot be changed, altered or modified.
Entry documents, including any written documents, photographs, or other materials, become the property of Our Oakland and will not be returned.
Awards and Judging:
Prizes:
- Grand Prize: iPod Nano 8GB (with Apple Care)
- Second Prize: iPod Shuffle 4GB
- People’s Choice Award: iPod Shuffle 4GB
Winning photos will be prominently showcased on the Our Oakland home page.
Awards Criteria:
Entries will be judged based on the following:
- Creativity and originality – 30%
- Aesthetic appeal – 25%
- Best explanation of your image– 20%
- Personal and emotional reaction to subject – 25%
Finalists: Members of Our Oakland team will review entries using Awards Criteria to select 10 Finalists. Once the Finalists’ are selected, the photos will be featured on the Our Oakland home page.
Finalists will also be contacted by Our Oakland and required to submit proof of age, parental permission, and other materials, including full resolution electronic jpg files of submission. Finalists who do not submit these materials within five (5) days of contact may be disqualified.
Winners: Grand Prize winner and Second Prize winner will be selected from the Finalists by a panel of qualified judges including a member of the Our Oakland team, a member of a community organization, and a representative from the Oakland Public Library. The entry with the highest score according to the awards criteria will win the Grand Prize. The entry with the next highest score will win the Second Prize.
Winners will be notified via e-mail on or about July 16, 2010, and must sign and return a Declaration of Eligibility and Liability/Publicity Release within five (5) days of the date of notification in order to claim the prize or prize will be forfeited and awarded to the entry with the next-highest score. Our Oakland is not responsible for lost, late, or misdirected e-mail. Unclaimed prizes will not be awarded. Prize is non-transferable prior to award and no substitution of prize is allowed except in Our Oakland’s sole discretion. Our Oakland reserves the right to substitute prizes of equal or greater value. All applicable federal, state and local taxes are the sole responsibility of the winner. If winner is considered a minor in his or her state of residence, then the prize will be awarded in the name of a parent or legal guardian, who must also sign the declaration of eligibility and liability releases, as applicable.
Decisions of Our Oakland and Judges are final and binding.
Our Oakland reserves the right not to award all prizes in the event an insufficient number of eligible entries meeting the minimum judging criteria are received, as determined by Our Oakland and Judges in their sole discretion.
People’s Choice Award:
The "People's Choice" is a section apart from the rest of the contest and the votes will not influence the judges. A photographer would seek votes in order to win the "People's Choice" section alone. The winners for the other categories will be determined by the judges. Public voting runs from the moment the video or poster is made available online for public viewing to 11:59 p.m. PST on July 12, 2010.
Timeline:
The contest will be open from May 1, 2010, 12:00am until July 8, 2010, 11:59 pm. PST
ENTRIES SUBMITTED AFTER July 8, 2010, 11:59 pm PST WILL NOT BE ACCEPTED.
Voting for the People’s Choice Award will remain open until July 12, 2010 11:59 pm PST.
The Finalists will be announced on ouroakland.org on or about July 12, 2010 and notified via email.
The Grand Prize, Second Prize, and People’s Choice Award winners will be announced on the website on or about July 16, 2010 and notified via email.
Each entry is eligible for one award only.
All results posted are unofficial until winners respond to e-mail notification. Response must be no later than five (5) days after notification.
Right to cancel or suspend Contest
If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Our Oakland that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Our Oakland reserves the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Our Oakland elects to cancel or terminate the Contest, Our Oakland will not retain any rights in the submitted photographs.
Additional Contest/Legal Details
Before being declared a winner, Entrant must complete, sign and return an Affidavit of Eligibility, Release of Liability, a Travel Release, and where lawful a Publicity Release within the time stated in the notification. If documents are not returned in the time period specified, or if the documents are returned as non-deliverable, or if a Winner is found to be ineligible or otherwise not in compliance with these Official Rules, the Winner and the Winner's entry will be disqualified, and all rights to the prize will be forfeited.
If this occurs, Our Oakland may, at their sole discretion, select a Winner from the remaining eligible entries.
Acceptance of any prize related to the Contest constitutes permission for, and Winners' consent to, Our Oakland and their agencies or assigns to use the entries and the names and/or likenesses of the Contestants for advertising and promotional purposes, in any media now known or hereafter devised, without further notice, compensation, consideration, review, or consent, and without regard to moral rights, unless prohibited by law.
Our Oakland reserves the right to disqualify Entrants from the Contest if Our Oakland, in its sole discretion, reasonably believes that any Entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices, or has tampered with the Our Oakland website, the submission process, the judging process, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner, or annoys, abuses, threatens, or harasses Our Oakland, their agents, their officers, employees, partners, their assigns or any other Contest participants.
You (and your parent or legal guardian) waive any claims or damages of any kind or nature whatsoever, including but not limited to, direct, special, indirect, incidental, consequential or punitive damages, should Our Oakland (or Our Oakland 's subsidiaries, affiliates, directors, officers, employees, partners, agents and assigns) pursue, use or exploit, in any manner, your entry in the Contest or any entry from any third party.
OUR OAKLAND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR ANY ENTRANT'S PARTICIPATION IN THE CONTEST. CONTEST ORGANIZERS SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM OR RELATES TO PARTICIPATION IN THE CONTEST, THE OUTCOME OF THE CONTEST, OR WINNING OR USE OF A PRIZE, INCLUDING BUT NOT LIMITED TO:
- LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES;
- TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND;
- FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS;
- THE DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THE CONTEST; OR
- ANY OTHER CONDITION THAT MAY CAUSE THE CONTEST TO BE DISRUPTED OR CORRUPTED.
Our Oakland is not responsible for any typographical or other error in the printing of the Official Rules, administration of the Contest, or in the announcement of the prize.
Any attempt to deliberately damage the content or operation of the Contest is unlawful and subject to legal action by Our Oakland or their agents.
OUR OAKLAND RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND, TERMINATE, OR CANCEL THE CONTEST OR ALTER THE RULES INCLUDING CONTEST DATES FOR ANY REASON, INCLUDING, BUT NOT LIMITED TO, IF AT ANY TIME A COMPUTER VIRUS, TECHNICAL PROBLEM, SUSPECTED OR ACTUAL EVIDENCE OF ELECTRONIC OR NON-ELECTRONIC TAMPERING WITH ANY PORTION OF THE CONTEST, OR OTHER EVENT ALTERS OR CORRUPTS THE ADMINISTRATION OR INTEGRITY OF THE CONTEST.
Release: BY ENTERING THE CONTEST, EACH ENTRANT RELEASES AND AGREES TO INDEMNIFY AND HOLD HARMLESS OUR OAKLAND AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS AND ASSIGNS, RENE YUNG, RENE YUNG COMMUNICATION DESIGNS INC., THE CITY OF OAKLAND PUBLIC ART PROGRAM, AND THE OAKLAND PUBLIC LIBRARY, FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH:
The Contest and the rights and obligations of Our Oakland and Entrants will be governed by and controlled by the laws of the State of California, USA, applicable to contracts made and performed therein without reference to the applicable choice of law provisions.
Any dispute or matter pertaining to or arising out of the Contest or the Official Rules shall be resolved via binding arbitration through Judicial and Mediation Services ("JAMS") in its San Francisco office. The arbitration shall be conducted pursuant to JAMS rules and policies for binding arbitration, including selection of an arbitrator, and the prevailing party shall be entitled to recover damages and other relief to the same extent allowed had an action for breach or violation of this Agreement been brought in state or federal court in California. The prevailing party shall be entitled to an award of reasonable attorneys' fees and costs incurred in bringing or defending the claim, as determined by the arbitrator.
The federal and state courts within the County of Alameda in the State of California shall be the exclusive venue and shall have the exclusive jurisdiction to adjudicate (1) any dispute as to the enforceability of the arbitration provision included above and (2), in the event that a court of competent jurisdiction determines that such arbitration provision is not binding on the parties, all actions, litigation or disputes pertaining to or arising out of the Contest or the Official Rules.
Entrant information submitted as part of the registration process will be collected in accordance with Our Oakland's Privacy Policy, which can be found at http://ouroakland.org/privacy, subject to the other provisions of these Official Rules.
The names of the winners will be announced and posted online at ouroakland.org in or about July 2010.
The Contest Organizers are: Our Oakland : Eastside Stories, a public art project of the City of Oakland Public Art Program for the East Oakland Community Library at 81st Avenue.
